TERMS AND CONDITIONS

 

PUMP “FLOW BY DAY/NIGHT” PROMOTION 2018/19

  1. These Terms and Conditions of Entry relate to the “Pump Flow by Day or Flow by Night” promotion brought to you by Pump (the Promotion).
  2. This Promotion opens at 12:00:00am on 1 October 2018 and closes at 11:59:59pm on 27 January 2019 (Promotion Period).

 

ENTRY

  1. Purchase any specially marked 750mL bottle of Pump to get your unique code on the back of the bottle.
  2. To participate in this Promotion, you must be a New Zealand resident aged 14 years or over. If you are between the age of 14 and 18, the prize will be transferred to your parent or guardian who is 18 years or older.
  3. You can only enter each unique code once.
  4. Each unique code can be entered once by either:

    TEXT YOUR CODE: Send the unique code followed by your choice of destination (Vegas or Bahamas) as a text message to ‘381’ to enter.  You may enter using any NZ mobile phone (021/022/027/029). Standard network rates apply, typically 20c. Text charges may not be covered by text-inclusive packages, check with your network operator. Please ensure you have permission of the person who pays the mobile bill before entering via text; OR 

    ENTER ONLINE: Go to www.pump.co.nz and enter the unique code, name, contact details and destination choice (Vegas or Bahamas)

  5. EACH CODE = 1 ENTRY IN THE MAJOR PRIZE AND 1 ENTRY IN THE RELEVANT WEEKLY DRAW: Entry of a unique code by text or web is automatic entry into the weekly prize draw on the day that code was received by the Promoter as well as entry to win the Major Prizes, drawn at the end of the Promotion.
  6. Entry in to this Promotion is deemed acceptance of these Terms and Conditions.
  7. The Promoter is not responsible, and will not be liable, for any lost, incorrect, or misdirected text or web entries, or any text or website entries not received by the Promoter, or for unreadable unique codes.
  8. You must ensure that your entries are received by the Promoter during the Promotion Period.
  9. The Promoter’s employees, all employees or contractors of associated companies and agencies of the Promoter and their immediate families are not eligible to participate in the Promotion.

 

PRIZES

  1. There are two (2) major trip prizes to be won (the Trip Prizes) and sixteen (16) weekly prizes of $500 cash (Weekly Cash Prizes) to be won weekly during the Promotion Period.
  2. The two Trip Prizes to be won during the Promotional Period are:
    1. Bahamas Trip: There is one (1) trip for two (2) to the Bahamas to be won which comprises:
      1. Return Economy Airfares (including all applicable airport taxes and government levies) for two people to the Bahamas from Auckland, Wellington or Christchurch International Airport;
      2. One-night stopover in Los Angeles at the Crowne Plaza Los Angeles International Airport Hotel;
      3. Airport Transfers in both Los Angeles and Bahamas; and
      4. Seven nights’ All Inclusive (includes meals, snacks and non-alcoholic beverages) accommodation for two people (twin share) at a 4.5-star hotel in the Bahamas.
    1. Las Vegas Trip: There is one (1) trip for two (2) to Las Vegas to be won which comprises:
      1. Return Economy Airfares (including all applicable airport taxes and government levies) for two people to Las Vegas from Auckland, Wellington or Christchurch International Airports;
      2. Airport transfers in Las Vegas;
      3. Seven nights’ accommodation for two people (twin share) at a 4.5-star hotel in Las Vegas; and
      4. NZ$5,000 spending money.
  3. The total prize pool for the Trip Prizes is at least $26,766.

 

PRIZE DRAWS

  1. The Trip Prize will be drawn at 12.00pm on Monday 28 January 2019. All entries that text/entered Bahamas will go in the draw to win the Bahamas Trip, all entries that text/entered Las Vegas will go in the draw to win the Las Vegas Trip. Any entries that did not specify which trip was preferred will be randomly allocated to either the Bahamas or Las Vegas Trip Prize draw.
  2. The Weekly Prizes will be drawn randomly each Monday throughout the Promotion Period, with the first Weekly Prize draw taking place on Monday 8 October 2018 and the last Weekly Prize draw taking place on Monday 28 January 2019.
  3. The Prize draws under this Promotion will be randomly drawn and independently supervised.
  4. All winners will be notified via mobile number which the entry was made from or the phone number entered when entering online. The Promoter is not responsible for any undelivered text messages or e-mails due to the winner’s mobile or internet settings.
  5. If a winner does not reply to the Promoter within ten (10) days of notification of being a Prize winner, the winner’s entry will be declared invalid and the Promoter reserves the right to randomly draw a new winner of the Pump Promotion from the eligible participants on the same terms and conditions as the original draw.
  6. All Weekly Cash Prize winners must nominate a New Zealand bank account into which the Prize will be paid. If the winner does not have a bank account, they are able to nominate another person’s New Zealand bank account into which the Prize can be deposited. No Prizes will be paid to winners other than via a New Zealand bank account.  Each entrant confirms that they have the consent of the account holder to pass such of the account holder’s personal information, as is necessary, on to the Promoter.  The Promoter accepts no liability for any dispute between the nominated account holder and the Prize winner in relation to funds deposited into a nominated bank account.
  7. Once a Weekly Cash Prize winner has been contacted, the Promoter will ask for details of a New Zealand bank account to enable transfer of the Prize. Bank transfer times will depend on the Prize winner’s bank.
  8. It is the winners responsibility to disclose to the Inland Revenue Department the receipt of a Prize and to pay any taxes that may become due. The Promoter accepts no responsibility for any tax implications that may arise from winning a Prize.

 

TRIP PRIZE CONDITIONS

  1. The Trip Prizes exclude the items listed below (such list in not exhaustive) and are therefore the responsibility of the winner and his/her travel companion:
    1. Transportation expenses to either Auckland, Wellington or Christchurch Airports (where the flight to Las Vegas and Bahamas leave from);
    2. Valid passports and applicable visas;
    3. All other costs and personal expenses (other than the NZ$5,000 spending money for the Las Vegas Trip Prize) such as shopping, transportation (other than the transportation specified), food and beverage expenses and taxes;
    4. Accommodation related charges other than the room rates such as phone calls, room service, in-room movies, laundry, mini-bar charges, loss of hotel property, damage to hotel property, or any other expenses incurred in the hotel other than those stated above;
    5. Accidental insurance coverage; and
    6. Travel insurance.
  2. The winner’s travel companion must be 18 years or older, unless the winner is the legal guardian of any travelling companion under 18 years of age.
  3. Both Trip Prizes must be taken before December 2019. All travel date requests are subject to availability. No alterations, extensions or variation on these travel dates or arrangements will be permitted.  All components of the Major Prizes must be taken together.  Any changes or additions to the booking may incur a cancellation or amendment fee, at the cost of the winner. The winner will be solely responsible for his/her travel companion, including ensuring that the travel companion complies with all applicable laws and regulations.
  4. Both Trip Prize winners must notify the Promoter of the name, age and contact details of the persons that they wish to nominate as their travelling companion along with any special needs or requirements (such as whether wheelchair access is required) within five (5) days of being notified that they are a winner.
  5. Trip Prize winners will be required to sign a "Participation Agreement" in the form required by the Promoter, confirming acceptance of these Terms and Conditions of Entry; accepting the Terms and Conditions relating to the use and enjoyment of a Trip Prize; releasing the Promoter, and its officers, directors, shareholders, employees, advisors, assignees, agents, licensees, representatives, advertising and promotional agencies from any and all liability in connection with this promotion and/or a Trip Prize.
  6. Trip Prize winners are responsible for their entry, and the entry of all travel companions, into the USA and the Caribbean, including the obtaining at the winner’s expense, and holding, of any necessary passports with recommended validity and visas(ESTA). If the winner, or his/her companions, are unable to use any element of the Major Prize for whatever reason, including refusal of entry or departure into/out of the USA or Caribbean or participation in certain activities for health, behaviour or safety reasons no compensation will be payable.
  7. Trip Prize winners and their companions take the prizes entirely at their own risk.
  8. Taking the Trip Prize is also subject to any prevailing terms and conditions of any accommodation / transport / services / transfers / ticket providers, and in particular, any health, behaviour, age and safety requirements. Any tickets or vouchers issued as part of the Major Prize is subject to prevailing terms and conditions of use, are only valid for use within the stated duration on the tickets or vouchers issued, and are not replaceable if lost, stolen or damaged.
  9. Trip Prize winners must have a valid credit card which is required for hotel and other travel expenses not covered under the Trip Prize.

 

GENERAL

  1. Prizes must not be sold or used, donated or given away as part of another promotion.
  2. By accepting a Trip Prize or a Weekly Cash Prize, winners express consent to the Promoter to be able to provide his/her and their travelling companions’ personal details.
  3. The Promoter may refuse to award a Prize to you if, in the Promoter’s sole opinion, you have breached these terms and conditions or has gained an unfair advantage in participating in the Promotion.
  4. Entry into the Promotion is deemed authority from you to Vodafone, Telecom and 2Degrees to release your phone number(s) to the Promoter (or its agent). By entering a unique code, you consent to the Promoter contacting you at the contact details provided regarding any Prizes won.
  5. The Promoter’s decision is final, and no correspondence will be entered into.
  6. Any person suspected of cheating in the opinion of the Promoter through the manipulation of entry, creation or use of software to aid in multiple entries and otherwise fraudulently falsifying data or acting in any way fraudulent, in the opinion of the Promoter, will be removed from this Promotion and damages may be sought.
  7. You consent to the Promoter using your name, likeness, image and/or voice in the event you are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  8. The Promoter collects your personal information in order to conduct this Promotion. If the information requested is not provided, you may not participate in this Promotion.  All personal information provided by you will be held for the Promoter at Farrimond Ltd, Level 1, 5 Eglon Street, Parnell, Auckland, New Zealand or such other place as is notified to you on request.  Under the Privacy Act 1993, you have the right to access and correct their personal information.  A request to access, update or correct any information should be directed to the Promoter at the address set out below.  The Promoter will destroy all personal information once the Prizes have been claimed.
  9. The Promoter reserves the right to modify these Terms and Conditions of Entry at any time for any reason.
