TERMS AND CONDITIONS – Pumped Sparkling Be In To Win With The Iconic Voucher Promotion

  1. These are the terms and conditions for Pump’s BP promotion with Pumped Sparkling for 2020.

  2. This Promotion opens at 12:00:00am on 28 September 2020 and closes at 11:59:59pm on 25 October 2020 (Promotion Period).

ENTRY

  1. Purchase any 2 (two) x 650mL Pumped Sparkling and/or 750mL Pump bottles to receive your entry card from the cashier.

  2. To participate in this Promotion, you must be a New Zealand resident aged 15 years or over.

  4. TEXT YOUR CODE: Send the unique code as a text message to ‘381’ to enter. You may enter using any NZ mobile phone (021/022/027/029). Standard network rates apply, typically 20c. Text charges may not be covered by text-inclusive packages, check with your network operator. Please ensure you have permission of the person who pays the mobile bill before entering via text.

  5. You will receive a text message back confirming your entry. The response will also have a 25% off code that may be used until the 30 November 2020 at theiconic.co.nz or direct from text response link. Go to https://www.theiconic.com.au/terms-of-use/#voucher for instructions on how to use the discount code and the terms and conditions that apply. Any questions relating to the 25% discount shall be referred directy to THE ICONIC and not the Promoter. The Promoter accepts no responsibility for any change to THE ICONIC terms and conditions.   6. 1 (one) winner will be drawn everyday at 12pm (NZDT) during the Promotional Period (Daily Winner). E.g. One winner from all entrants who enter their unqiue code on 28 September will be drawn on 29 September, the 29 September winner will be drawn on the 30 September and so forth.

  7. The first valid entry drawn randomly from the relevant daily entries during the Promotion Period will win the Prize (Daily Prize).

  8. Each Daily Prize draw will take place at 12pm at Farrimond Ltd, 5 Eglon Street, Parnell, 1052, Auckland.

  9. Entry in to this Promotion is deemed acceptance of these Terms and Conditions.

  10. The Promoter is not responsible, and will not be liable, for any lost, incorrect, or misdirected text entries, or any text or entries not received by the Promoter, or for unreadable unique codes.

  11. You must ensure that your entries are received by the Promoter during the Promotion Period.

  12. The Promoter’s employees, all employees or contractors of associated companies and agencies of the Promoter and their immediate families are not eligible to participate in the Promotion.

PRIZES

  1. There are 28 x THE ICONIC $1,000AUD Gift Cards to be won during the promotion (each a Prize).

  2. Total Prize Pool $28,000AUD.

  3. Once the winner is verified the $1,000AUD Daily Prize will be sent by the Promoter via email to the winner. The email will include a code that the winner can use when shopping on The Iconic. Codes will be sent via email to the winners nominated email account. You must use your unique code in accordance with the terms and conditions stated on https://www.theiconic.com.au/terms-of-use/#vouchers9. The Promoter’s liability is limited to the initial supply of the code to the Prize winner via the nominated email address only. The Promoter will not be liable for any subsequent use of the code, any defect with the Prize (subject to any applicable law) or any loss of or damage to the Prize in transit to the winner.

  4. Prizes are not transferable, negotiable, exchangeable or redeemable for cash. Each Daily Prize is to be awarded to the registered owner of the mobile phone from which the unique code is sent.

  5. If the winner does not get in touch with the Promoter within ten (10) days of notification of being a Daily Prize winner, the winner’s entry will be declared invalid and the Daily Prize will be redrawn.

  6. The Promoter accepts no responsibility for any tax liability incurred as a result of an entrant winning a Prize. Entrants should obtain independent tax and financial advice.

  7. Winners should be aware that orders shipped to New Zealand in one or more parcels valued at NZ$1,000 or greater may incur duties, GST, customs charges and fees imposed by the New Zealand Customs Service at the point of entry into the country. Winners will be responsible for all such duties, taxes, charges and fees and the Promoter will not be liable to the winner for any liability incurred in claiming their Prize.  The Promoter strongly recommends that the winner familarise themselves with the online shopping section of the New Zealand Customs Service website prior to purchasing: https://www.customs.govt.nz/personal/online-shopping.

  8. If THE ICONIC business suffers from any unforeseen financial circumstance such as liquidation or receivership between 01.10.2020 and 01.10.2022 and the winner is unable to fully redeem their prize, the Promoter will make a cash payment to the Prize winner for the unclaimed portion of their Prize. 

GENERAL

  1. Daily Prizes must not be sold or used, donated or given away as part of another promotion.

  2. The Promoter may refuse to award a Daily Prize to you if, in the Promoter’s sole opinion, you have breached these terms and conditions or have gained an unfair advantage in participating in the Promotion.

  3. Entry into the Promotion is deemed authority from you to Vodafone, Spark and 2Degrees to release your phone number(s) to the Promoter (or its agent). By entering a unique code, you consent to the Promoter contacting you at the contact details provided regarding any Daily Prizes won.

  4. The Promoter’s decision is final, and no correspondence will be entered into.

  5. Any person suspected of cheating in the opinion of the Promoter through the manipulation of entry, creation or use of software to aid in multiple entries and otherwise fraudulently falsifying data or acting in any fraudulent or dishonest way, in the opinion of the Promoter, will be removed from this Promotion and damages may be sought.

  6. The winners have rights under the New Zealand Consumer Guarantees Act 1993 which cannot be excluded or limited by the Promoter. These rights include statutory guarantees that any goods provided by the Promoter will be of acceptable quality and fit for purpose, and that any services provided by the Promoter will be rendered with due care and skill. These Terms and Conditions do not, and do not intend to, exclude or limit those statutory rights in any way. However, to the extent it is permitted by law to do so, the Promoter makes no representations or warranties, express or implied, under laws other than the New Zealand Consumer Guarantees Act 1993 regarding the quality or suitability of the Prize awarded as part of this Promotion and will not be responsible for breach of such representations or warranties.

  7. Subject to any applicable laws which cannot be excluded, the Promoter, its employees and agents will not be liable for any loss, damage or injury of any nature incurred or suffered by any person (including but not limited to direct or consequential loss or loss arising from negligence) arising directly or indirectly out of or in connection with this promotion or with winning, redeeming or benefiting from the Prize.

  8. If, for any reason beyond the Promoter’s reasonable control, any aspect of the Promotion is not capable of running as planned, or the conduct or operation of the Promotion is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, tampering, government imposed restrictions, computer bugs or viruses or technical failures), the Promoter reserves the right to, in its sole discretion, cancel, terminate, modify, suspend or recommence the Promotion, or invalidate any affected entries, at any time without prior notice, subject to any applicable law.

  9. If the Prize is unavailable for any reason, the Promoter reserves the right to substitute the Prize with a substitute prize of equal or greater value.

  10. You consent to the Promoter using your name, likeness, image and/or voice in the event you are a winner (including photograph, film and/or recording of the same) in any media and without remuneration for the purpose of communicating the outcome of this Promotion.

  11. The Promoter collects your personal information in order to conduct this Promotion. If the information requested is not provided, you may not participate in this Promotion. All personal information provided by you will be held for the Promoter at Farrimond Ltd, Level 1, 5 Eglon Street, Parnell, Auckland, New Zealand or such other place as is notified to you on request in accordance with the Promoter’s privacy policy, which can be viewed here: https://www.ccamatil.com/privacy-policy.  Under the Privacy Act 1993, you have the right to access and correct your personal information.  A request to access, update or correct any information should be directed to the Promoter at the address set out below. The Promoter will destroy all personal information within a reasonable period of time following the Daiy Prize being claimed.

  12. The Promoter reserves the right to modify these Terms and Conditions of Entry where reasonably required.
