PUMP “SPLASH ‘N CASH” PROMOTION 2022/23

1. These Terms and Conditions of Entry govern the “SPLASH ‘N CASH” promotion brought to you by Pump (Promotion).
2. This Promotion opens at 12:00:00am on 3 October 2022 and closes at 11:59:59pm on 29 January 2023 (Promotion Period).

ENTRY

3. To participate in this Promotion, you must be a New Zealand resident aged 15 years or over (Eligible Entrant). If you are between the age of 15 and 18, any prize will be transferred to your parent or guardian who is 18 years or older.
4. Purchase any specially marked 750mL bottle of Pump (Promotion Pack) in participating retailers to get your unique code on the back of the label (Qualifying Purchase). Online purchases are excluded.
5. Each unique code can be entered once.
6. To enter scratch the panel on the back of the label to reveal the unique code, scan the QR code on the label or go directly to www.splash.pump.co.nz, enter the unique code and follow the instructions to find out if you are an instant winner.
7. All prizes will be awarded via pre-selected, random, computer-generated winning timestamps during the Promotion Period. If you are the first person to enter their code at or after one of the pre-determined, randomly generated timestamp (Preliminary Winning Entry), you will be the preliminary instant winner of the nominated prize.
8. Entry into this Promotion is deemed acceptance of these Terms and Conditions.
9. Employees of the Promoter, Coca-Cola Europacific Partners New Zealand Ltd and their contractors, associated companies, participating stores and agencies, and any immediate family members of such employees, are not eligible to participate in the Promotion.
10. Each Entrant can enter into this Promotion a maximum number of five (5) times per day during the Promotion Period. Any entries in excess of five (5) in one day will be removed from the Promotion and the unique codes can be re-entered by the Entrant the following day.

11. There are 205 total cash prizes available to be won (each a Cash Prize) during the Promotion Period.
12. When entering online, all Eligible Entrants of a Preliminary Winning Entry will be re-directed to a redemption page on the promotional website where they will need to confirm their eligibility and enter their contact details in order to redeem their prize.
13. The two hundred (200) $250 Cash Prizes will be couriered to each winner in the form of a Prezzy Card. Prezzy Cards will be unlocked but winners will need to go online to www.prezzycard.co.nz to register their card prior to use.
14. The five (5) $10,000 Cash Prizes will be paid out via direct credit to the winners’ chosen bank account number. Once a $10,000 Cash Prize winner enters their details on the prize redemption site, they will be contacted by the Promotor in order to verify their win and organise their prize payment.
15. All Cash Prizes will be paid out or dispatched within 21 days of receipt of requisite account/contact details from the winner, subject to any COVID-19 restrictions causing a delay in the physical dispatching of prizes. In that case, prizes will be dispatched once postal services are able to operate.
16. The Promoter is not responsible or liable to replace misdirected or lost Cash Prizes should the winner enter their bank account details or postage information incorrectly.
17. The Cash Prizes are not transferable, exchangeable or negotiable.
18. It is the winner’s responsibility to disclose to the Inland Revenue Department the receipt of a Prize and to pay any taxes that may become due. The Promoter accepts no responsibility for any tax implications that may arise from winning a Cash Prize. Entrants should obtain independent tax and financial advice.

 

GENERAL

19. The Promoter may refuse to award a Cash Prize to you (including if you have a Preliminary Winning Entry) if, in the Promoter’s sole opinion, you have breached these terms and conditions or have gained an unfair advantage in participating in the Promotion.
20. It is recommended to keep Promotional Packs as proof of purchase as they may be requested by the Promoter. In some cases, you will be asked to send in your Promotional Pack to validate an entry or to claim a Prize up to 21 days after entry. If asked to do so, you have 28 days in which to comply. After 28 days, the Promoter reserves the right to not reward a Prize.
21. Entry into the Promotion is deemed authority from you to Vodafone, Telecom and 2Degrees to release your phone number(s) to the Promoter (or its agent). By entering a unique code, you consent to the Promoter contacting you at the contact details provided regarding any Prizes won.
22. The Promoter’s decision is final, and no correspondence will be entered into.
23. Any person (including someone who has a Preliminary Winning Entry) suspected of cheating in the opinion of the Promoter through the manipulation of entry, creation or use of software to aid in multiple entries and otherwise fraudulently falsifying data or acting in any way fraudulent, in the opinion of the Promoter, will be removed from this Promotion and damages may be sought.
24. You consent to the Promoter using your name, likeness, image and/or voice in the event you are a winner (including photograph, film and/or recording of the same) in any media for a reasonable period of 24 months without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. Winners will be included on the “Winners” list on the promotion website following receipt of confirmation.
25. The Promoter collects your personal information in order to conduct this Promotion. If the information requested is not provided, you may not participate in this Promotion. The personal information of entrants may be provided to others assisting in the conduct of the Promotion, including the Promotion administrator, suppliers and deliverers, and to any authorities that regulate the Promotion. Entrants may contact the Promoter by calling the toll-free number 0800 262 226 or by emailing privacyau@coca-cola.com to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an entrant does not provide accurate personal information, the Promoter may determine that they are not eligible to win a Cash Prize. Entrants acknowledge that their personal information may be supplied to organisations outside of New Zealand and they provide their consent for this to occur by participating in the Promotion.
26. If the Promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter, including but not limited to, infection by computer virus, bugs, tampering, unauthorised intervention, acts or omissions of third parties, technical failures, governmental restraint, order or regulation, public health crisis such as a pandemic or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion. Any cancellation, termination, modification or suspension of the Promotion will be notified on the Promoter's website at www.pump.co.nz/promotion/splash-and-cash/terms
27. The Promoter reserves the right to amend, suspend or terminate the Promotion and these Terms and Conditions at any time if it deems reasonably necessary.
28. To the full extent permitted by law, the Promoter, its related companies and Coca-Cola Europacific Partners New Zealand Ltd and agencies and all those entities' personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any person in connection with the Promotion or Prize, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these Conditions is intended to exclude, restrict or modify a person’s rights under the Fair Trading Act 1986.
